TERMS OF SALES

This page (together with the documents referred to on it) tells you about us and the terms and conditions (the Terms) under which we sell products (the Products) to you on our website (our Site). These Terms apply to any contract entered into with you for the sale of Products (the Contract). Please read these Terms carefully and ensure that you understand them before ordering any Products from our site.

By ordering any of our Products, you acknowledge that you are 18 years of age or older and you agree that these Terms and the other documents referred to herein are binding on you. Please print a copy of these Terms for future reference.

Guitars Rebellion only sells on its site to end customers. Any order that clearly does not correspond to a retail sale operation and, more generally, any fraudulent order or one supposed to be such, is considered by Guitars Rebellion to be null and void. Guitars Rebellion reserves the right to cancel any order without notice if in doubt.

We are entitled to modify these Conditions at any time, as indicated below. Whenever you order Products from this site, please review these Terms to ensure that you understand the terms that apply to your order.

2. THE PRODUCTS.

2.1. The description of the Products on our site is approximate and the images of the Products are given for illustration purposes only. Whilst we endeavor to be as accurate as possible in the description of the Products on our site (including but not limited to their size, weight, functions and dimensions) and to accurately reproduce the colors , any description remains approximate and we cannot guarantee that the colors displayed on our site accurately represent the true color of the Products.

2.2. The packaging of the Products may also differ from that shown in the illustrations on our site.

2.3. All the Products appearing on our site are presented subject to availability. We will notify you by e-mail as soon as possible if the Product you have ordered is not available. If the Product you ordered is no longer manufactured or unavailable, we will not process your order.

2.4 The Products comply with French and European legislation.

3. ORDER - TERMS OF CONTRACT BETWEEN YOU AND US.

3.1. Our order process allows you to check and amend any errors before sending us your order. Please take the time to check your order before sending it to us. If you send us an incorrect order, please contact us at info.grebellion [a] me.com or +33(0)1 45 86 49 80 as soon as possible to correct the error. We will endeavor to correct any error in the order you have submitted to us before it is processed, however we cannot guarantee that this will always be possible given our shipping times which are usually very short (a few hours ).

3.2. The online sales contract is concluded when you confirm the order by clicking on the "SEND / VALIDATE ORDER" button (the "Order"). By placing an Order, you accept these Conditions and you agree that Guitars Rebellion is entitled to collect the full price corresponding to the Order.

3.3. After placing an Order, you will receive a confirmation email from us. Another e-mail informs you of the dispatch of the Order (Confirmation of dispatch).

3.4. If we are unable to supply you with a Product (for example, because it is not in stock, it is no longer available or because of an error in the price on our site) , we will notify you by e-mail for and do what is necessary to offer you an alternative. We can cancel your order on request. If you have already paid for the Product, we will refund the full amount to you as soon as possible and, in any case, within 14 days of the notification that we send to you by e-mail.

3.5. Guitars Rebellion reserves the right to suspend or cancel the processing of an Order and/or the delivery of Products regardless of their nature or stage of processing in the event of (i) non-payment of all or part of the sums due under the Order concerned or any previous Order, (ii) a payment incident, fraud or attempted fraud related to the use of the Guitars Rebellion site under the Order concerned or any other previous Order . You agree that Guitars Rebellion may use the personal data provided by you in connection with the Order in order to conduct appropriate anti-fraud investigations. As part of the fight against Internet fraud, data relating to your Order may be transmitted to any third party authorized by law or designated by Guitars Rebellion for the sole purpose of verifying your identity and validating the Order, the method of payment used and type of delivery. After carrying out the above checks, Guitars Rebellion reserves the right to request a photocopy of your identity document. You have the right to access, modify and delete any personal data processed by Guitars Rebellion in accordance with the conditions set out in the Privacy Policy.

4. DELIVERY.

4.1 Guitars Rebellion ships worldwide with the exception of territories that are politically unstable, in a state of war, or for any reason the carriers cannot deliver.

4.2. Shipping and handling charges are automatically calculated and included in the total price of your Order. As a general rule, we send all items using a reliable carrier. Depending on the country of delivery, please allow 20 hours to 7 calendar days for delivery once dispatch confirmation is received. Regarding Orders delivered outside the European Union, please note that Guitars Rebellion cannot be held responsible for any extension of the delivery time due to customs controls which may vary depending on the destination and the legislation of the country in which the Product is delivered.

4.3. Please refer to the delivery confirmation email from our carrier for accurate information and package tracking reference.

4.4 You are invited to check the visual condition of the package and the Product at the time of delivery. In the event of a problem (missing or damaged Product), you must follow the procedure below applicable to the refusal of delivery.

If the package is damaged upon delivery, you can inform the carrier of the problem and refuse delivery. The carrier then retains the package. You are then contacted by Guitars Rebellion customer service as soon as possible to review the refusal. If the transport-related problem is confirmed by Guitars Rebellion customer service, the Order is canceled and you are refunded.

5. PRICE OF PRODUCTS AND DELIVERY COSTS.

5.1. The prices of the Products are those indicated on our site at all times. Please refer to Section 5.5 for information regarding pricing errors on our site.

5.2. The prices of our Products are subject to change at any time. Any change in the price of the Products on our site does not modify the Order of the Product(s) that we have confirmed to you by means of a Dispatch Confirmation.

5.3. The Products are likely to be subject to local customs duties, as well as to the value added tax applicable in your country of origin. Taxes are automatically calculated and included in the total price of your Order if you live in the European Union.

5.4 Orders placed outside the European Union are processed duty free. The Guitars Rebellion carrier carries out the necessary formalities for you to pay customs duties (if applicable) and VAT (if applicable).

5.5 Our site contains a large number of Products. It is possible that, despite our best efforts, some of the Products on our site may be priced incorrectly. If the pricing error is obvious and obvious and you could reasonably recognize it as such, we are not obliged to supply the Products to you at the incorrect (lower) price. In this case, we will contact you to inform you of this error and we will give you the option of purchasing the Product at the correct price or canceling your Order. We do not process your Order until we have received your instructions. If we are unable to contact you using the contact details you provided during the ordering process, we will consider the Order canceled and notify you in writing.

6. PAYMENT.

6.1. The prices on our site are in EUROS.

6.2. You can pay for the Products only using a debit or credit card or by bank transfer (in case of payment by bank transfer, contact us by e-mail, you will receive an e-mail with all the details for transfer purposes). You agree to pay the full price of any purchase made, either when placing your Order online or by any other means of payment acceptable to us. Payment for the Products is made in advance.

6.3. Certain Products that you purchase from our site may be subject to Additional Terms presented to you at the time of purchase.

7. RETURN.

7.1. We want your Order to bring you complete satisfaction. Subject to certain exceptions described below, if you are not satisfied for any reason, we will gladly accept the return of the Product within 14 days of receipt, at your expense. To return an item to us, please follow our returns procedure outlined below.

7.2. All Products must be returned to us in unused and new condition, with all the original packaging used for transport and the Product, protective materials and labels in the appropriate places.

7.3. We refuse any return if the Product shows signs of handling other than those necessary to establish the nature, characteristics and operation of the Product, or if it has been used or modified in any way from its initial state. , or if the period mentioned above and in paragraph 7.1 is exceeded.

7.4. Personalized, made-to-measure, out-of-stock and specially ordered Products at the request of the customer are considered final sales and cannot be returned for exchange or refund.
Products benefiting from a sale, specific reduction or any other exceptional discount cannot be returned. Products modified at the customer's request, before shipment, requiring specific adjustments (tuning, string pull and other adjustments requiring even minimal modification of the instrument) cannot be returned. Return shipping costs are the responsibility of the customer. In the event of free delivery, offered following a commercial or specific gesture (express delivery, Saturday), the outward shipping costs are the responsibility of the customer and will be deducted from the amount of the refund, unless otherwise agreed with our customer service.

7.5. To be able to return one or more products, you must obtain an RMA number. Without this number, your return will not be accepted.

7.6. The return is made from the country where the Product was delivered.

7.7. To return a Product to us, please follow our return procedure below:

- You must contact Guitars Rebellion by calling +33(0)1 45 86 49 80 or by sending an e-mail to info.grebellion [a] me.com, within 14 days of receipt of the Product,
- Our team will then ask you a few questions to make an initial assessment of the situation, taking into account the return conditions described in this article 7,
- Provided that this first assessment confirms that the return conditions seem to be met, our team contacts our carrier and you are contacted either by him or by our team to organize the shipment,
- You deliver the Product to our carrier,
- You receive an email confirming receipt by Guitars Rebellion of the returned Product,
- Guitars Rebellion checks the condition of the Product and, provided that the conditions set out in paragraph 7.3 are met, reimburses you the full price.

7.8 We will refund to you the price paid for the Product using our preferred method of payment, unless another method has been expressly agreed. Guitars Rebellion does not bear the cost of returning the Product. We process the refund as soon as we receive the returned Product.

7.9 Please note that products shipped outside the European Union do not benefit from this return policy. Due to customs barriers and the application of French VAT on imports from foreign territory, we cannot accept product returns, except for one of the following reasons: breakage, defective or non-compliant product.

8. OUR RESPONSIBILITY TO YOU AS A CONSUMER.

8.1 You benefit from the legal guarantee of conformity and for hidden defects of the Product applicable under French law. As a consumer, you also benefit from the mandatory provisions of the law of the country in which you reside (in Europe). Nothing in these Terms, including the choice of law clause below, affects your right as a consumer to rely on these mandatory provisions of local law.

8.2 In addition to these legal guarantees, please note that the Product you have purchased is also covered by a commercial guarantee (Guitars Rebellion Local Guarantee) the conditions of which are set out in the guarantee document and/or the page to which the link leads included in the original packaging of the Product. After-sales services for the Products are also available and may be provided by Guitars Rebellion and the brands we work with. After-sales services provided for a Product not covered by the Guitars Rebellion Guarantee or by that of the manufacturer are the subject of an estimate and are only carried out after validation of the estimate by the consumer.

8.3 If Guitars Rebellion fails to comply with these Terms, we are liable to you for any loss or damage you suffer which is the foreseeable result of our breach of these Terms.

8.4 We only supply the Products for domestic and private use. You agree not to use the Product for commercial, business or resale purposes. Further, we shall not be liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

9. EVENTS BEYOND OUR CONTROL.

9.1. We shall not be liable for any inability or delay in performing any of our obligations under a Contract where such inability or delay is caused by an act or event beyond our reasonable control ("Event Beyond of our control”).

9.2. If an Event Outside Our Control occurs that affects the performance of our obligations under a Contract:
(a) we contact you as soon as possible to let you know.
(b) our obligations under a Contract are suspended and the time for performance of our obligations is extended for the duration of the Event Outside Our Control. If the Event Outside Our Control affects the delivery of the Products, we will agree with you a new delivery date after the Event Outside Our Control ends.

10. HOW TO GET IN TOUCH AND COMMUNICATE WITH US.

10.1. In these Terms, the term “in writing” includes email.

10.2. You can contact us for any reason using the following means:

(b) by telephone on +33(0)1 45 86 49 80 (Tuesday to Saturday 10 a.m. to 7 p.m. Central European Time).

10.3. If we need to contact you or notify you in writing, we will send you an e-mail or postage prepaid to the address you provided to us in your Order.

11. OUR RIGHT TO CHANGE THESE TERMS.

11.1. We may revise these Terms at any time. You should read these Terms carefully before purchasing any Product from our site.

11.2. Whenever you order Products from us, the Terms applicable at the time of the Order apply to the Contract you enter into with us.

11.3. If we revise these Terms and you have already placed an Order with Guitars Rebellion, the revised Terms will not apply to the Order you placed.

12. HOW WE USE YOUR PERSONAL INFORMATION.

We use the personal information you provide to us for the purposes set out in and in accordance with our Privacy Policy and these Terms. Please take the time to read it, as it contains important terms that apply to you.

13. OTHER IMPORTANT TERMS.

13.1. We may transfer our rights and obligations under a Contract to another company, but this does not affect your rights or our obligations under these Terms.

13.2. You may only transfer your rights or obligations under these Terms to another person if we consent to this in writing.

13.3. This Agreement is between you and us. Except as expressly provided in this Section 13.3, a person who is not a party to this Agreement has no right to enforce any of its terms. The rights of the parties to terminate, cancel or accept any modification, waiver or settlement under this Agreement are in no way subject to the consent of any other person.

13.4. Each of the paragraphs of these Terms is independent. If a court or a competent authority decides that a stipulation is illegal or unenforceable, the other stipulations retain their full effect.

13.5. If we fail to require you to perform any of your obligations under these Terms or if we fail or delay to enforce our rights against you, this does not mean that we have waived our rights against you nor that you are not bound by these obligations. If we waive the requirement that you remedy a breach, we do so only in writing, and any written waiver does not mean that we automatically waive your right to remedy any subsequent breach.

13.6. To the extent permitted by applicable law and subject to any mandatory provisions of the law of your place of residence and the content of the “COUNTRY SPECIFIC ADDITIONAL ADDITIONAL” clause below, these Terms are governed by the law Switzerland, so that a contract for the purchase of products through our site and any dispute or claim arising from the said contract (which includes non-contractual disputes or claims) are governed by French law and you agree that the courts of Paris, France have exclusive jurisdiction.

Nothing in these Terms, including that relating to choice of law and jurisdiction above, affects your rights as a consumer to rely on the mandatory provisions of your place of residence.

14. ADDITIONAL TERMS AND CONDITIONS BY COUNTRY.

France. Your rights as a consumer.
Notwithstanding any stipulation to the contrary in these Conditions, you benefit from (i) the French legal guarantee of conformity of the goods described in articles L 217-4 and following of the Consumer Code and (ii) the guarantee for defects hidden in the conditions provided for in articles 1641 and following of the French Civil Code.

When you act within the framework of the legal guarantee of conformity, you:
- benefit from a period of two years from the delivery of the article to act;
- can choose between repairing or replacing the item, subject to certain cost conditions set out in article L 217-9 of the Consumer Code;
- are exempted from providing proof of the existence of the lack of conformity during the first twenty-four months following the delivery of the item.

You can decide to invoke the legal guarantee against hidden defects provided for in article 1641 of the Civil Code and, in this context, you can choose between the cancellation of the sale or a reduction in the price, in accordance with article 1644 of the Civil Code.
If you return a Product to us, we will refund the price paid for the Product to you using the payment method you originally used, unless another method has been expressly agreed. We process the refund when we receive the Product or when you provide us with proof that you have returned the items, whichever occurs first. Please note that you can bring proceedings in the courts of the place in which you are domiciled.
